Ok,me and my friends were in an alleyway of a building and my friend was smoking pot. So We walk out along with a few girls laughing and an undercover car comes by. They get out of the car (three people with badges and a gun), and come towards us slowly telling us to stop walking. They smell pot and right away tell us to get against the wall while they frisked us. They checked absolutely everything, it was cold. They didn’t let us go and threatened to send us to Rutgers Island. They double questioned us..... They tried to look for the joint… It was funny. I started talking to him and about his personal life... We did not have anything on us illegal. I was wondering what did the cops violate and what could they done by the law? Were they messing with us in the first place? Please everything is welcome; i want to know my rights.
Thank you.

BTW me and my friends have clean records and none of us ever did anything. THIS HAPPENED IN BROOKLYN Née

You mean Rikers Island. They could have detained you for public intoxication, you would have gotten an over night in jail and a huge ticket. Given that this was the NY PD they could have taken your smart mouth havin' azz back to the alley and kick the s.h.i.t out of you and your friends.

The police officers smelled marijuana and therefore have probable cause to begin a search of all the people in the group, this would include any bags, backpacks, purses, etc. These officers did nothing wrong. They had a clear reason, the smell of marijuana, to believe that someone in the group was in possession of a controlled substance, which is a crime. You admit that one of your friends had been smoking marijuana, also a crime. The officers did not violate your rights.

You were not violated in anyway you have no case. The only way you would have anything was if you were frisked by an opposite gender police officer if you were a female and you were frisked by a male for an example. however, i dont believe it works in the opposite way with females frisking male potential offenders.
