I'm a girl, so I'm gonna ask this with the girl being younger and the guy being older.
I looked up the age of consent in Florida and it says that to engage in sexual activity with a guy under 24 you have to be atleast 16. But, if the guy is 24 or older you have to be 18. so I was wondering, what if the girl is 16 and the guy is over 24 can they still just control themselves and cuddle, kiss, and maybe even date until she turns 18 and they can do all the other "fun stuff"? Do they have to get parental consent?
When I read it it was so confusing.

Being around a man that is older than you is no illegal. You can date him, but he can't have any type of sexual intercourse with you. I don't think your parents can have him thrown in jail for just dating you. So I don't think you have much to worry about unless your parents won't let you date him.

In florida if you are 16 and he is 24 you can give consent but if your parents dont then he can still be arrested because you are not of legal age to consent. He might say he'll wait but he wont. At 16 you dont want to get invoved with at 24 year old that too much older. It wouldnt work out. Find someone closer to your age when you turn 18 you can date all the older guys you want. You can do all the other stuff but a 24 year old in not interested in that trust me.

Hi there! You pose a really good question. First of all, it is important to realize that each state makes their own laws in these situations. Unless you cross the state lines for the "purpose of committing an immoral act," it is a state matter.
Usually gender is no basis for bias, but in prosecuting cases, it very well may be a consideration. Typically, a parent cannot give consent for their underage child to have a sexual relationship. If it is a relationship that all parties consent to, then it is highly unlikely to be prosecutable offense, because there are no vicitms. Some over eager attorneys might try to seize an opportunity to gain their two seconds of fame by using such a case, but it is doubtful. Usually, these kinds of cases are brought to light when the parents of the under age person find out, are angry, and seek an avenue for retribution. There are other instances that occur with students and teachers, babysitters, neighbors, etc, and you may never hear about them, depending on who becomes involved.
This is really a crime similar to driving offenses, prositution, sodomy, etc. because it is a victimless crime. That is, until someone claims to be injured by the situation, then it takes a whole new persona.
My advice, check the laws of the state. Also, you can just wait until marriage to have sex, then the only person at fault is you for chosing the bum! :) Just teasin!

If the guy's over 24, the girl has to be at least 18. If the guy's under 24, she can be 16 or 17. What is so hard to understand about that???

Ok it is simple--all kids can't wait to have physical relations. The age factor is because most teens are not capable of making rational decisions about sex---that's where all the babies come from---and of course the diseases. So first--take time to be informed--look up what sex is and what it takes to have safe sex to avoid all the problems. A 24 or 25 year old with you or any underage girl sounds as odd and perverted as can be--admit it--are you going to take this guy to the prom?? He will look like you brought your uncle. He has nothing but sex with a kid on his mind--he doesn't care about anything else--if he did truly respect you-he wouldn't want sex until you were 18 and legal and informed. I am serious--you will be sorry for the rest of your life if you take up early with this guy. You only think you like him--he is a smooth operator. Let him wait--and you wait too...it won't be that long. If it is illegal and you are caught--he goes to jail--and in Florida--jail is tough on molesters--he will have all the sex he wants in there. Sorry if you don't like the answer--but you need to understand you are not the first to be gooey over some old guy--then kicked to the curb with a baby or a drip that never stops.

The age of consent is meant to protect the young girl, from a guy who is taking advantage of her. Society does not think a 16 year old is mature enough to make decisions and that the older male will manipulate her.
IT IS illegal for them to have anything that can be labeled as "sexual conduct", but this is not limited to just sex. Grabbing her behind, touching her breast, can get him into a lot of legal trouble, in fact, even making sexual comments to her is illegal.

No girl that age should be with someone that age....He will hurt you, and use you.....He will always tell you what you wish to hear and he will hurt you because you have not experienced life yet. Forget about marriage....He will get you pregnant and leave and then what. There is no cinderella anymore...No College, no home, no money, no nothing especially with a child which most men create with really young girls to trap them with control....Be careful and smart.....Sex will always be there and you will find you enjoy the "Fun stuff" with someone closer to your age and maybe when you are a little older........

Cindy, I'm guessing you are 16. I'm a lot older than that and Id like to suggest that any man of 24 who has a 16 year old girl as his girlfriend, is probably very immature. He also probably wont want to wait until she is 18 to consummate the relationship. Kissing and cuddling might sound good to you, but a man that age is going to want more. Please reconsider your relationship, and if there is a woman older than you that you can talk to, please do.

why date an older guy. senior in hs ok whatevs but a guy older than 24?! just watch out for his other girlfriend ok honey? and there is no way ur parents would consent so give up now.

You are confusing parental consent with statutory rape. parental consent is for marriage, it does not control statutory rape, that is a legal issue... You should not even be talking to somebody 24 if you are just 16. He is not interested in cuddling and kissing sweety, he just wants one thing and I think you know what that is......Nuf Said
