situation: so-called friend asked to cash check for him because he did not have a checking account, said he's been working there for awhile and that everything is good to go, had check in my name, now I'm charged with a felony charge.. I did not know he was setting me up and did not know he was using me. I had no knowledge of what he was trying to do at all. I cannot believe how incredibly naive I was. he kept reassuring me that check was "real," but was not valid at all.

what should I do? I have a Public Defender representing me and cannot afford a real lawyer. i am a full time student and have never done anything wrong before my entire life.

Just tell them the truth. Tell them the whole story. Tell them exactly what you typed. Also try to make a deal with the D.A. and if nothing decent comes up with the DA just tell them the whole story.

Good luck!

Not much to do but hope you have a good public defender, the fact that you have never been in trouble with the law should be in your favor as toward jail time

but remember if you decided to plead to a lesser charge in exchange for no jail time, just remember what ever charge you plea to will follow you for ever where ever you go, hence maybe the DA will see fit not charge you in exchange for testifying against you Friend

good luck God Bless

The prosecutor decides whether to proceed on a case or not and has absolute discretion in doing so in most states (absent an improper motive). They can drop the case but usually felony cases are reviewed before being charged so you may have to go to trial if you believe that you are innocent.

you shoulda told him to go to the bank that issued the check and cash it there. I'm betting this guy has always been a scumbag and you should have known better. See if you can hire a mobster to break his legs for your trouble.

Well did your not-so-good friend do this to anyone else before?
