Section 3 of Article II of the U.S. Constitution commands that the President of the United States "shall take care that the laws be faithfully executed." Additionally the President appoints public ministers, consuls and other officers of the United States. Implicit in these constitutional duties is an obligation to both investigate criminal activity and prosecute criminal laws.

On the state and local levels, where most criminal laws are enacted, the police and prosecutors offices are part of the executive branches. These entities investigate and prosecute criminal activity.

To ensure that the laws of the land are enforced and that the Constitution of the United States is upheld. The executive branch as well as all other branches of government take an oath of office to uphold both the laws of the land and the Constitution of the United States of America. We have checks and balances that are supposed to ensure that no one branch can take absolute power or abuse power. Doesn't seem to be working in Bush's case unless Congress ***** slaps him.

The supreme court justice is not a tenure it is a lifetime position. To get rid of a justice you would have to have them impeached. Otherwise they would have to die or retire.
