The closest they can get to you would be your router, which is what actually has the Internet IP address (not the computer). As the ownder of the router, and the network run from it, you would be responsible for its use. So you could be sued if one of your neighbors where to download copyrighted material over your network. By leaving it unsecured, you gave your permission and consent to their actions.
If you are lucky, all they will do is download music. All they can do is fine you. If instead they were to download child porn, make terrorist threats, hack into government sites, etc., you could go to prison for the next 30 years instead.
Do yourself a favor, secure your network before the FBI does it for you.
(I work in the computer IT business, and I see this happend to people every day)

Yes, they can prove it. Your computer has a physical address that is unique, regaurdless of the IP. You better turn yourself in.

whether or not they have a case won't stop them from trying to sue you, they don't have a case 90% of the time, they just sue for such large amounts that no one wants to take the risk and instead settle out of court

yes all PC's have a unique MAC address and besides all they have to do is FIND pirated music/moves on your PC how it got there is not as important as the fact that its there is
