If a female is from another country but is here on a student visa, and is of legal age of consent in her country of origin and citizenship, but is under the age of consent in california. what does the law have to say about the female engaging in unlawful sexual penetration with a male above the age of consent?

The local laws apply(as stated with other posters, the age of consent is 18 in California):

If the girl is under the age of consent, and the guy is 'over' the age of consent...it's illegal...

No 'if's,' 'and's,' or 'but's'.....

California law would apply. The age of consent in California is 18.

Local laws apply. She is under the age of consent in the region where the act would take place. I think that would make it statutory rape.
