There are telltale signs that you can look out for when something isn't right, such as a seller that has a large number of a new CD or DVD for a very low price, which usually means a bootleg, or a seller who sells autographed items and has a large number of the exact same item, which usually means a fake. In the end, your best hope is to read the feedback. Look at what people are saying in their comments, especially in the negative ones. Most sellers usually go out of their way to ensure that there are no complaints, so when one gets through it usually means quite a bit. Skim through the positive ones too. In the midst of all the "Super EBayer, A++++++++" nonsense, there's usually a thoughtful comment about what exactly happened.

You ask the seller questions, you look at the sellers past ratings and reviews by other ebay buyers who have done business with that particular seller.
