I won baseball tickets on Ebay, I requested the total from the seller, but 4 days went by, and the seller did not respond. I won the auction on a saturday, and the game was on the coming friday. I wanted to pay promptly, so he could ship them asap. I kept emailing the seller, with no answer each time. I was very upset, and I told him that I was not interested in buying the tickets anymore because he made me wait so long. He finally emailed me wednesday, saying he was out quote " international(?) (out of town?)" Can he sue me for not paying? What is the worst that could happen if I dont pay? Please help.

** the game is on friday 4-6-07. I bought other tickets from another seller because I assumed he changed his mind on selling the tickets. He didn't tell me he was out of town, no email, no notice, at least to let me know that he would send respond a couple of days later.

The seller is suppose to contact you within 3 days. If he was selling a time critical item, he should have stuck around.

The worst that can happen is that you will get an Unpaid Item strike if he files a Non-Paying Bidder action against you. You need three of these before it matters so don't worry about it too much.

Simply email the seller telling him since you didn't hear from him in the time required by eBay, you had to buy elsewhere and you no longer want his auction. Instead of the NPB report, he can file saying you both agree not to complete the auction.

If he doesn't want to do that, simply leave him negative feedback i.e., ""No contact with seller within 3 day time limit on event tickets" or something and don't hassle any more with it. If he wants to remove the NPB strike so you'll update your feedback more kindly, then he can.

If you don't pay for the item in 3 days, the seller can file a UID (Unpaid item Dispute) against you. Ebay will contact you by email and request that you pay. If you don't pay, your buying account on ebay gets a strike. Three strikes and you're banned from being on ebay from now on.

If the tickets are still good, I think you should pay for them and use them. ebay isn't like a department store - most of the sellers are part-time and they have other things going on in their lives, too.

Give the seller the benefit of the doubt - I doubt that they went on vacation just to bug you.

When is/was the game? Is it still time for you to get the tickets and go. He can give you a negative but I doubt he can sue you.

ebay will put your account on hold. it happened to me.

my account was hacked, people won bids and I was told I had to pay...so I canceled my account and refuse to pay but even after canceling my account is still open I just can't buy or list anything...ebay is a waste of my time anyway.

the person can open a dispute but you can fight it since it was the guys fault not yours.

if he opens a dispute on your page, open one on his page.
