i went to get my kids back he wouldn't give them back to me, He is a jerk. I had a lawyer tell me all i needed was my divorce papers get them certified and that would be my court order. Well she was WRONG!!! We had did a temporary custody paper deal, 6 months to a year. But there was no temporary custody paper, because he never went to file them. He knew what he was doing. Now i am screwed. but i have a jerk for an ex husband. HE JUST DON"T WANT TO PAY CHILD SUPPORT! He has this girlfriend that sticks her nose in our business. For all you people that say go get them, It's not that easy if you have a real jerk for an ex husband. My kids want to come home he want let them!!! I didnt want to take them out of school, thats why i left them there for a year. All my life growing up i moved from school to school.I am not doing that to my kids!! My ex has all ways tried to run my life. I say everything to him. But it doesn't work for him. O and by the way I live in Florida.

if you knew he was a jerk..why did you leave them? i understand the school issue i moved alot..but you still left them..you obviously think he is a good father if you can go off and leave them..get another lawyer and try to get them back is going to be the only way..you are going to have to prove why you are the better parent..and are you?

Ok, then sue him in court and once there petition the court to let the children decide who they want to live with. This is becoming quite normal nowadays. The Judge will take the kids into his chambers and ask them a few questions and if he likes the answers, he will be favorable to let them voice for their choice and if there are no legit objections he will usualyy make his ruling based on their choices, provided there are no legalities in the way of the choice. Your actions dont /shouldnt be based on what your ex is or does. Youre your own person to take charge here and use the courts help. Just petition the court for a remodification for custody hearing to get this into court and go from there. Explain your situation to the Judge and hope for the best. Get rid of the temporary custody but there should have been a final and permanent order in your divorce decree stating the terms of custody and probably giving you custody s residential parent so no need for certification because the Judges signature is all the certified you need. I feel your pain!!!! I did the same thing with my ex. I had our children stay with him while I finished school. It was almost a year later and I told him I would be moving them 45 minutes away. He hurriedly got an attorney and sued me for custody. In our divorce decree I was granted custody but he and I had an ORAL agreement for the rest of the time until I finished my degree.
Well...to make a REALLY long story short...the judge said the "status quo" was fine and granted him custody. He did this all behind my back (telling me everything was fine until the day I got served with his stupid papers).
I would get an attorney and fight. I exhausted my 401K and IRA plans fighting it..to no avail. It sucks! Especially when you trust someone and they screw you over in the end.
