Like with any of the laws or regulations, Bush will abuse it because he thinks of himself as more a supreme dictator than a President of a democracy.
The emergency appointment rule is there for urgent need when things are at an impasse. For Bush, and urgent impasse is whenever he doesn't get whatever he wants.
For another snapshot of his mindset, continue to listen to Bush spin the fact that the Dems gave him every penny he asked for in funding, he is going to veto it, and then will claim the Dems haven't passed funding for the troops.
He only gets outraged when the Congress has the nerve to execute it's authority under the Constitution. That's awfully inconvenient when Bush is trying to staff government positions to faithful political hacks and flunkies.
