Contact a local Paralegal to draw up the paperwork for dad to sign to relingusih his paternal rights to his daughter and then file a petition for a court hearing for a Judge to review your request and decide either way. The Paralegal is just as good as the attorney and will saveyou a ton of money, and can also drwa up adoption papers for your new husband to file. Good luck

I'm not a lawyer, but if this means your kids never have to be around Mr. Abusive again until they're of legal age and can choose to do so themselves, then GO FOR IT! If this means more peace for your household, GO FOR IT!
I would caution, however, that signing over custody rights may not automatically mean New Hubby can lawfully adopt your kids. Ask the lawyer.

If your ex is willing to relinquish custody now then go now and get the paperwork done by an attorney. He may change his mind later just to try and cause problems. I would not mention the whole step-dad adoption thing just get him to sign over custody.
Realize that this also releases him from child support forever. This may be a helpful piece of information to have if he starts waffling about signing.

do it for your kids, although you may lose some child support, but gaining full parental control over an abuser is soooo worth it. Show your son he is worth calling a lawyer and getting the toxic relationship out of both your lives.

If your husband has agreed to waive his parental rights then it is a pretty straightforward matter. You would be best placed to see a lawyer who will simplify the process but could start with a visit to the CAB who will be able to give an idea of costs and the process.

Yes, get a lawyer, understand that when this is done, he is not their father any more, it is the end, no support, no visits, nothing. It is like creating a non-person. Do not take this lightly, it is very important.
