i live in texas my daughter is 17 and now her boyfriend is 18 they been having sex for 4 months know startrd when he was 17 is it legal still in texas

With these ages this is not even an issue in any state, both are not children could even be in the same grade, the laws were not meant for this but much older people having sex with much younger people generally younger than 17. Your daughter is a young woman and not a child and will soon also be 18, do not try to interfere in her relationships or you may loose your daughter, insure she has access to family planning services. Time to let go mom and realize your daughter is a young woman, overreacting may damage your relationship with you daughter for years to come and she will be inclined to move in with her boyfriend as soon as possible. It's your daughters choice to be sexually active or not and she has already made her choice nothing you can do will change that. Time to relate to her as a young adult and develop an adult relationship with her, one that you'd like to have for years to come, time is on her side the big 18 is rushing in. In fact I bet she is just a few months even weeks from 18 herself.

Be civil to her boyfriend you never know at this point if he may or may not be your future son-in-law or father of your grandchild. My sister had a falling out with her daughters boyfriend ,although they never married, they had a child together and my sister has never seen her grandson in fact she has not seen my niece either in the last 3 yrs. I have and our other siblings have but my sister has been cut out of their lives till who knows when. Any mention of her mother to my niece or her boyfriend gets the b-tch word thrown around.

By the way what is so unusual about a 17yr old and an 18yr old dating, both ages are usually in the Senior Class, all young adults. 17yr olds and 18yr olds serve side by side in the military, marry etc.

Yes. The age of consent for texas is 17. Even if it was 18 your parents wouldn't have a good chance of convicting your bf of statutory rape because you're probably going to be 18 before they even get there court date. But like I said you are fine.

I have to ask the question of what is the point you want to make here? Are you planning on charging him with statuatory rape and put him in jail possibly and have your daughter testify? That would be the end of yours and hers relationship I think.

If the problem you have is you don't like him for whatever reason this is NOT the way to deal with it. You'll drive them to do something stupid. All kinds of couples in high school have this issue. Make sure she understands the risks involved and talk with her.

She is old enough to give consent in TX. But legality is not really the issue. I assume you have a strong relationship with your daughter as you know when she began having sex, however, make sure you talk to her about keeping her self healthy and protected.

Well, California's age of consent for sex is 18. So technically being sexually active with him is illegal. But as for simply dating, there's no laws against that as far as I know.

I think that in most states that is leagal. In some states, the age is even younger. Even if it is illeagal, presasing charges would just be a waste of time and money. No jury in their right mind would convict him, Also, it will just make your daughter hate you, and push her away.

yes, i think texas' legal age of consent is 17. I think you could press charges if you wanted to... but she is old enough to give consent.

Who cares if it's legal or not? That's completely irrevelant. What is important is if they love each other, and if they are smart enough to understand the risks involved. If they are, there is little to worry about.

§15.031 – Criminal Solicitation of a Minor (Under 17)


A person commits an offense if, with intent that of the following offenses be committed, the person attempts to induce a minor to engage in specific conduct that, under circumstances as the actor believes them to be, would either:
1. Constitute an offense under one of the following sections, OR
2. Make the minor a party to the commission of the offense under one of these sections:
a. §21.11 (Indecency with a Child),
b. §22.011 (Sexual Assault),
c. §22.021 (Aggravated Sexual Assault), or
d. §43.25 (Sexual Performance by Child)

A person cannot be convicted under this section on the uncorroborated testimony of the minor allegedly solicited unless solicitation is made under circumstances strongly corroborative of both the solicitation itself and the actor’s intent that the minor act on the solicitation.

It is no defense to prosecution under this section that:
1. The minor solicited is not criminally responsible for offense solicited,
2. The minor solicited has been acquitted or been convicted for a different offense, or is immune from prosecution,
3. The actor belongs to class of persons legally incapable of committing the offense in an individual capacity,
4. The offense solicited was actually committed.

An offense under this section is one category of punishment lower than the solicited offense.

well your daughter must love her boyfriend, but she shouldnt be haveing sex more than one time in a month.
