My husband and I bank with Bank of America. We have for the past 2 years. My husband has his own business account so he can cash his checks and if he needs something, use his money. He wrote out his truck payment of 405.75 to the bank he got his loan through. They put the check through and it would have only been over drafted $217.43. Well Bank of America returned the check and charged us $35.00. Since my husband wrote out the check for his loan, we hadn't used his account so no money would be taken out. Bank of America saw this. After they returned the check, his account was back in the positive, so he bought food, deisel, and also new business cards. Well, we went up to the bank where he gets his loan, and paid cash. They informed us that they had tried to put the check through again yesterday, but they would not charge us their fee for returned checks.
But now bank of america put the check through this time, with all the charges that my husband had made on diesel, food, and b-cards

that put all that stuff after the check when his account would have covered it had they now not put through the check.

My thing is, they only put this check through AFTER they saw that my husband had made additional charges using his debit card. WHY do they keep doing this? If they returned it before when we would have only been over drawn a lesser amount, and then decide because they can make more money off of overdraft fee's that they'd go ahead and put it through and move the other payments my husband had made using the debit card AFTER the check?

I wonder if any one else is having trouble with Bank of America? If you aren't banking with them, I would suggest not.

Friends have told us that Bank of America will treat you really good when you first open an account, but when you've been there a while, they will try and screw you over.

OH Boy! Bank of America returned the check the first time. We had no problem with that. So we took money out of my account and paid the bank my husband got the loan from with cash. THAT'S when that bank( not BOFA) informed us that they had tried to put the check through again.

When B O A returned the check the first time, my husband then had the positive balance back in his account. So, he used that money he had in the account for food, deisel, and new business cards.
When the bank he got his loan from put the check through again- this time B o A decided to put it through- even though the account would be MORE over drawn(negetive $389.00) than it would have if they put it through the first time. We are suppose to have overdraft protection of $350.00. Instead the bank put that check through again, and then all the other things that my husband spent money on after- which means more over draft fees- which means out account would be negetive $500.00

How in the world is this B of A's fault?

You wrote a check with insufficient funds. What made you think it would clear? And it's not like it was just a few bucks, $217 is a big overdraft.

Then the bank you wrote the check through redeposited the check just like most payees. My question would be, why did they do that if you'd paid in cash? And how is any of this B of A's fault? They get a check for payment and they HAVE to try and make payment. B of A didn't know you'd already settled with the payee, they're just trying to make good a check that's been presented to them. They can't read your mind.

You weren't careful AT ALL and you're trying to blame someone else. If the first check hadn't bounced then you wouldn't have any problems. Pay attention.

There isn't someone in a back room trying to figure out the best way to screw you. You should have known that there was a check for the truck sitting out there that the other bank would try to redeposit. Why didn't you tell the other bank not to redeposit? It's common for payees to redeposit a check that's been returned.

Usually a check will be put through twice before returning. Then, if it is NSF again, they return and charge you the $35.
If a deposit was made in between time and charges made exceeding the deposit, then your account would still be in the red.

Talk with them again and see what you can do to protect yourself from overdrawn amounts -- check on a Financial Wizard account.

Oh strong grief, in case you've been extremely overdrawn on the ATM then they have each and every proper to charge you for it. you won't be able to heavily be blaming them for "letting you" withdraw the money, are you able to? Are they your dad and mom? BOA is merely one crappy economic company among many. all of them replace their expenditures and guidelines about as frequently as i adjust my blouse, and they in no way enable everybody study it. I merely went through weeks of attempting to close my account with them because they utilized month-to-month expenditures to an account that wasn't meant to have a fee. yet extremely, you merely do not look to appreciate that if you're overdrawn for one minute - for one 2d - any economic company will hit you with overdraft expenditures.
