How much does a very good lawyer charge in rupees to handle a suit which has several cases in India on average. Do lawyers charge by the law suit or by each case being heard under a lawsuit? What is the fee structure?

Also is it a norm for India lawyers provide a written retention agreement to their clients?

Fee of a lawyer in India depends on various factors :- 1) The Court where case/suit is to be filed or is pending, Whether it is in district level/court or High Court Or The Supreme Court or before any Tribunal or Arbitrator. 2) The seniority of the Lawyer. 3) The number of effective dates the case/suit will on an average take to be decided, here in a civil matter although, from the time of preparing & filling of any suit/case, notice/summon to the parties, appearance of the parties, forming of the issues of the case, examination of evidence of the parties, arguments of the parties & final verdict/judgment , along with these there are many interlocutory applications which the parties may file during the pendency of the main suit/case are also to be taken up & decided, all such matters take not only months but years to finally come to end & in between all these issues there are always ineffective dates which the lawyer/advocate has to attend which takes his precious time when only a next date is given for further hearing due to absence of the dealing judge not present on a particular day or for any other reason beyond the control of the lawyer/advocate or the court. 4) Lawyer charges either on the basis of the main suit along with/or without, the presumed interlocutory applications that may be filled during the main suit, or they may charge on daily basis according to the effective date or ineffective date he attends.5) Nature of the main suit/case, here certain matters are directly between two or three persons/property can be smaller but if the matter concern large number of persons/property etc it is bigger & more time consuming. 6) Value of the suit/case, the value involved is another issue that is taken into consideration while deciding the profession fee as the risk involved in such suit/cases is higher in more the valued of the suit/case. Here in we can say a suit involving petty matters like maintenance of wife requires lesser risk but matter involving property worth millions of rupees in dispute has more risk as involvement of many parties, many issues that may be criminal in nature become related such a property, involvement of political person or pressure, or involvement of unsocial factors or people etc All such things have to be considered by the lawyer/advocate that can be risk to him in person. These are few of the factors on which fee of the lawyer depends. As far any written retention agreement is concerned it can be done on terms & conditions agreeable to both the parties i.e. the litigant & lawyer/advocate. In India, there is no code for lawyers fees and for fees for medical practitioners. Neither the Bar Council nor the Medical Council have done anything to fix any norms or guides lines in this regard. It is a kind of law of the jungles. If you have a good practise, you charge for the time you spend for conference, appearance in the court etc. If you do not any brief, you some how try to get it and fleece the client. It is a very sorry state of affairs in India.

There is Court Fees & Suit Valuation Act and Advocates' Fees Act on the civil side. However advocates take more or less than that. Advocates charge at their wish in criminal cases with no legal restrictions. Advocates file their appearance in engaged case after negotiating their fees, which usually range between US$ 2 to 5 thousands for the whole case including all court expenses. Fees depends from place to place, case to case and advocate to advocate.

Go see a few lawyers and talk to them make sure there is no fee for initial consultations.
