i was completely set up into helping a so-called friend cash his check unknowingly that it was fake. i was arrested at the scene. now i am charged with a forgery felony charge. i am in desperate need of help! I have a PD defending me in court this upcoming friday and i will be contesting this case. but the thing is. the friend had the check in my name! i cannot believe i did not find it to be suspicious whatsoever. i am terribly scared.

also, is there a way for my to press charges on him for slander and defemation of character or of the sort? i am desperate! please help me if possible. I cannot believe how incredibly naive and stupid to fall in the traps of this awful person. he is not a friend of mine. please help, i have been crying for days.

I am trying to fight this case and not get any felony charges, misdemeanors, or probation. I am a full time student and i have never done anything bad before and i am terribly scared to know i am in a situation as this.

First thing I would do is get your own attorney. While the job of a public defender is to defend his client, he may not be able to concentrate fully on your particular case. Im not sure what city you live in but, most PD's are overworked and that may not work in your benefit. If you can't get one by Friday, I would notify the court that you will be hiring your own attorney and its possible the judge will give you more time until your next court date.

As far as the case goes, it sounds like its going to be your word against his. Which makes it even more important you get your own attorney because you may be in it for the long haul. As far as the slander claim goes, you can't press charges on a person for slander. Its a civil issue in which you can sue him but, you are going to need proof. And thats likely going to take a conviction on his part for this crime.

In the states that I am licensed to practice law, forgery is a felony. I cannot imagine that any state would classify forgery as a misdemeanor, but one never knows.

Get a good lawyer fast. I would ask your friends look in the yellow pages, whatever. I would not put my future in the hands of a public defender. This is a felony, not a misdemeanor.

Tell the truth mabe the judge will plea it down so all you get is probation. I would offer to testify against my friend in exchange for a lessor charge. He set you up now look at the mess you are in, obviously he is not a true friend, just a user.
