Pleading the fifth is a reference to the fifth amendment. The fifth amendment is:
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
Which is more commonly used as a phrase meaning 'I don't want to answer your question because I have a right to my privacy.

That part of the 5th Amendment that you are refering to protects your right to not self incriminate yourself in a criminal proceeding.

This means that you do not have to say anything to the police or in court that may implicate you in a crime.

Many may say this is stupid because we want guilty people to admit it...but that about those cases where people say things and it comes out wrong and it makes them look guilty and they are not....happens more than you think.

pleading the Fifth", is the act of refusing to testify under oath in a court of law or any other tribunal (such as a Congressional committee) on the grounds that the answers that would be given could be used as evidence against the witness to convict them of a criminal offense.

The 5th Amendment protects your right not to answer questions and to make the government prove their case against you on their own.

To exercise that right, you merely just refuse to say anything to them.
