Ok here's the scoop. I'm divorcing my husband and that's all there is to it. But crap! I don't know how!! I got divorce papers off the internet but what do I do with them? Throw them at him? Do I really need a atterney? Look, my husband doesn't know I'm going to divorce him, so I can't really take him to the court house for the papers, shoot, I don't know what to do. Plus I have a baby, so I don't know how to do the cusiody stuff either. This is all California stuff. Ahhh!!! What do I do?

You don't need an attorney. But with a child involved you should have one! Your attorney can help you and help you navigate your way through the laws.

First go to your local court house by yourself and get the necessary paperwork for divorce.As long as your husband doesnt contest you then its a simple divorce with children. You dont really need an attorney if you cant afford one. You can always hire a Paralegal (yellow pages) which is just as good and a whole lot cheaper. Your husband will be served with divorce papers and if hes still talking to you or the divorce is mutual then sit down with him and work out the details. Its easier,saves time and the Judge loves it. Unless ruled unfit, you will be awarded custody of your children and child support and possible spousal support and the house, due to the kids. Your husband will be given Californias mandated visitation rights. The court will decide the rest, assests and bills unless you work them out outside of court. Now if he contests you over this, youll still get the divorce) but vits going to get ugly and nasty. It all gets started when you file the paperwork for divorce without him. Hope this helps. You need an attorney or contact a divorce mediation service. You sound a little out of control and trying to decipher California Family law in the state you're in would be a problem at best. At worst, it could be disasterous. Get a professional involved to insure that everyone's needs are met.

If kids and/or property are involved, it is best to get an attorney. Because even if you went to a paralegal to help you fill things out and file and serve him, chances are afterwards he'd get an attorney and things could get ugly.

Have you tried reading the papers that you have?
My ex and I did ours ourselves, we bought a book at the library and followed it step by step.
Sad thing is I don't think that its going to work in your case. Your husband has no clue which means he is going to get pissed. You have a child and if he is pissed he isn't going to want to let the child go with you, he will fight over custody, child support and alimony tooth and nail...
Id advise you to go to a attorney.
