the father is absent and i havent been able find him... also, is this a long process?

is this for the purpose that you are applying for the us passport? if so all you have to do is go to the nearest postal office and ask for that letter, that you have no knowledge of the father and are required to get ur child a passport. you would have to go to a Notary Public and notarize your statement that "you have no recollection of the father" and with that you can get the passport.
If this is not the case, then you need to go to the court house and process a sole custody since you have no knowledge of the father.

Babysister's response is a good example of why you need an attorney for this. Even if its just to consult with, don't try to go this alone. There are so many issues that will make it drag out. A good attorney will make sure that the process is quick and flawless.

Each state has its own rules and requirements for notice and filing. If money is an issue, go to the courthouse and speak to the clerk. There are a number of pro bono services that can assist you for a reduced rate or for free.

you get it from your court house. you must file to get sole custody. we dad is unknown whereabouts you may have to place an ad in paper. depends on age of kids and how long he's be gone and of curse state laws. if dad can not be found the judge gives you custody right then and there.

Never heard of such a thing. Do you mean an Order of Custody from the court?
