Does it depend on the state they were married in? What if the new marriage involves children? If the new marriage is not legal, does anyone know if the military recognizes it still?

I believe it is nationwide, that if there was no divorce in the first marriage, you are STILL legally married to that person, and the second marriage doesn't count, because the first one never ended. Happened to my aunt. She found out he was married, and that her marriage to him was not "official". Doesn't matter if kids were born of the second one or not. You can't get married again until you're divorced legally. And as far as the military, I'm pretty sure they'd look really ILL upon it. They're more strict on moral matters than the average American.

Second marriage is not legal. Does not matter which state you live in. Having children does not change that. The law, the church and the military will not recognize the second marriage.

If you didn't divorce the first one... it's called bigamy. It's is illegal in ALL 50 states. Even the military cannot recognize the second marriage as the first one was never dissolved. Usually you have to show your divorce papers just to get the license for the second marriage. Doesn't matter if their are kids or not, it's illegal and not recognized anywhere here.

No for one you are still married to your first wife. Secondly you have commited a crime it is called bigamy and can have fines and jail time involved. Thirdly are you that stupid not to even know if you had divorced your first wife? If anything the military will not accept this marriage is because you are not allowed to married to different people at the same time if anything you could be looking at getting court marshalled for doing this! Speak to a lawyer ASAP and find out what you can do or what he can do for you that will fix this dilemma?

Any state that is bigamy, you can go to jail for committing bigamy, if your not divorced. They recognize that you are still married to your first spouse. You can't go around marrying someone if you are already married that is against the law. It has nothing to do with what state your married in it is still not legal in any state. Having children makes no difference any where you are, you married to you first spouse until you are legally divorced from your fist wife. If the children are born with this second person their are illegitimate children.

No, it's no legal. Bigamy is against the law in the U.S. No, the military will NOT recognize the second "marriage" because it's not a marriage.
What kind of IDIOT gets married a second time without bothering to divorce the first?

I would think that if you used a licensed minister, got a marriage license and got married that both marriages are legal. Which is breaking the law and illegal to do and has a name "Bigamy". Websters says bigamy is"the act of entering into a marriage with one person while still legally married to another ".

If the person never divorced from the previous marriage then the new marriage is void and illegal, doesn't matter which state you are in. Which means someone lied on their marriage licence applicaiton.. which is a big NO NO
And no the miliary will not recognise the new marriage as its illegal..

I don't think the new marriage would count...I know here in Ohio you have to provide proof of divorce before taking out a marriage license.
Being married to more than one spouse is polygamy and is illegal.

the new one is void, no one will legally recognize it. The previous marriage needs to be anulled or dovorced before the second marriage can be recognized.
