I just heard this on the radio . Somewhere in the USA , a man has been incarcerated for about a year , and may be for life. . . . . .. . . . . . .even though he has not been charged with a crime !!!!!
Now before you Constitution experts answer , you should know WHY .
He has a very rare and very contagious uncurable strain of Tuberculosis . He was previously ordered by the court, to wear a face mask(mouth and nose) when in public, so he wouldn't spread this deadly disease . He ignored the judge and therefore he was locked up .
Anyone have a link to this story ?

I agree that he was irresponsible and threatened the lives of others. . and therefore cannot be trusted . He didn't deserve his disease , but neither do others !!

I didn't see the story. But where public health is concerned, the government has many little-known and draconian powers.
They can do things in this context that they NEVER could in the area of criminal law. And I doubt the courts would interfere.

I heard about him from law enforcement and he had a drooling problem and when he talked to people he would spray tuberculosis contaminated spit all over. He was basically assaulting people with a disease. Tuberculosis can kill because there is a lot of multi-drug resistant tuberculosis.
This type of tuberculosis is brought over from Mexico. There in Mexico they do not regulate the pharmacies and they do not have an FDA. Ignorant people over there, whenever they get sick, and they buy antibiotics alot. They take the antibiotics without doctor supervision and they stop taking the antibiotics when the symptoms go away not knowing that they are still affected. The remaining disease in their body fights off the antibiotics and becomes stronger. The illegal aliens from Mexico bring some really terrible drug resistant diseases with them. I once heard of an illegal who had gonorrhea that spread to his legs and the pus was soaking through his jeans.
I have to side with the judge on this issue. That stuff eats away at your lungs and you die a painful death. There are no drugs out there that can take the pain of suffocation away. Imagine if he infected your child?

Robert Daniels has been locked up indefinitely, perhaps for the rest of his life, since last July. But he has not been charged with a crime. Instead, he suffers from an extensively drug-resistant strain of tuberculosis, or XDR-TB. It is considered virtually untreatable.
County health authorities obtained a court order to lock him up as a danger to the public because he failed to take precautions to avoid infecting others. Specifically, he said he did not heed doctors' instructions to wear a mask in public.
"I'm being treated worse than an inmate," Daniels said in a telephone interview with The Associated Press last month. "I'm all alone. Four walls. Even the door to my room has been locked. I haven't seen my reflection in months."

Wow, that is very interesting. I'm glad you brought this to my attention. I know it is a terrible thing for him to be locked up, but it is for the best as he is a big risk for thousands of innocent bystanders...he basically is a WMD. His disease is the baddest-boy of them all, and highly contagious. Lots of these illnesses are popping up, you know why? Because people take antibiotics for the wrong reasons AND they don't finish their prescriptions...this causes the bug to become resistant to drugs and become a superbug. I've seen them a lot in the hospital Methicillin resistant staph aureus (MRSA), Vancomycin resistant enterococcus (VRE) and C. Diff....said to kill about 100,000 hospitalized patients a year. Moral of the story...finish your WHOLE prescription of antibiotics people!
They should give him better ammenities though, I mean give the man at least a mirror, geez.
EDIT: The guy below me is right, a constant influx of immigrants from 3rd world countries do put us at risk for these types of infections, read an article about it...yet another reason to secure our borders.

I don't see a problem.
Every time he breathes, he releases potentially lethal weapons into the air that innocent people might breathe.
He was offered his liberty at the price of taking reasonable measures to not endanger the public. He refused.
If you believe he has a right to do that, I'd be curious to know where you think that the Second Amendment allows the existence of the ATF.

Nevada has the same type of law that applies to HIV infected prostitutes. It is the same as assault with a deadly weapon or attempted murder. Most states allow for incarceration for an indefinite term for those that are convicted of crimes and found to be insane but culpable.

this is a tough issue.
as long as we only isolate people with air-borne diseases that won't take their medicine I think its okay.
once he takes some medicine he can go home.
but we should isolate people with other tranmittable diseases,
I heard someone propose we do with HIV.
I'm against that. I'm for punishing those who intentionally spread HIV (their have been cases of people doing it out of 'revenge' and one person giving it to random people in a way similair to how serial killers kill their victims)
there is someone in my city with TB. she was tested 3 times with 3 positive results and she still says the labs are wrong. she spends a lot of time with her young grandchildren- that is terrifing.

Thank God!! This is exactly the kind of biological warfare feared; and who knows if the terror driven nuts had a hand in this? No one has said where he traveled, in what country he went to to contract this, as he could not have been exposed in the US? Anyone know that?? God help us all!
