My Dad was arrested for back child support of about 44000.00.. (yeah I know that is alot) He is now in jail until he goes to court, I have looked at every internet site I can find tring to find out what kind of punishment he could get.. I am asking from other now, if you know what could happen. We are in Indiana so I know that may be different, he has been in trouble several times in the past. And he has been working and not paying it, if anyone could help please... thanks

I dont know if any of the time he was in trouble was child support, but about everything else you can think of..

Heather,I live in Indiana and paid child support for almost 15 years.I got behind once in a while,but never $44,000.And I always got it caught up.You dad knew exactly what he was doing in not helping to support his children,so in that regard I have no sympathy for him.
Now for your question.The child support office is at your county courthouse.It is called IV-D.Go there and ask to speak to one of the caseworkers,they can probably answer your question.They are a part of the county prosecutor's office,so if they don't have the answer you need,I'm sure they can send you to the right person.
Someone else here left an answer that the state might accept a reduced amount.That is not going to happen,I assure you.Your dad will be paying the full amount he owes.The state of Indiana doesn't negotiate child support.

This is going to take place in a Court of Equity, meaning the judge can pretty much do whatever they think is fair.
Probably the first thing they're going to look at is dad's net worth. If he has a house with that much equity, dad's probably going to have to mortgage his house and pay up to get out of jail.
If dad's broke, the amount might be reduced, or he may be put on a plan with higher payments to catch up.

You should go to a website like Lawguru.com and your question will be routed to an attonrey in your area. Attorneys on that website answer questions for free and I doubt any of the other answers you received are form attorneys.

The court will probably fine him for being in the position he is in. They may also give him jail time ( about 30 days ). The court will set up a payment plan that they expect him to keep up with. If he doesn't keep up with the plan they will put him back in jail. I am sorry for you that you have to struggle with this. It is not you fault for what your Dad did. Hang in there.

He'll probably have to serve a short jail sentence, then they will most likely garnish his wages. Then he doesn't have to worry about paying each month since the government takes it directly out of his paycheck.
