I have been the child's legal guardian for 8 years. The mother just recently entered the penal system, and wants to grant me temporary custody so I can take the child for a visit. The POA ends when she is scheduled for release. I don't trust her. I already need to fill out a form concerning the legal guardianship and have it notarized. I don't know why I also need to be granted temporary custody by the birth mother.

A POA has nothing to do with custody. If you are the legal guardian, I don't see how anyone can grant YOU temporary custody. You already have custody. YOU would not fill out a form for someone else to grant you anything. THEY would fill out any such form. It sounds to me like the mother is trying to trick you into giving her custody when she gets out.

I don't think you need to fill that out. Growing up my biological father went to the pen, and my mom took us all the time. They never asked us anything, they patted us down and had to go over us with a metal detector, but the NEVER asked to see that she had custody of us. The only thing that they did check was to make sure our names were on the visitation list. But then again i live in Texas. So you may want to just call the prison and ask them what is needed.

call the jail/prison and ask for yourself exactly what needs to be done. Maybe she's not telling the jail that you already have guardianship of her child. Alot of parents don't like to admit to that fact.
