EVERYTHING WAS FINE AT WORK UNTILL I GOT A PIERCING ON MY LOWER LIP... AS SOON AS MY BOS SAW IT HE SAID TO TAKE IT OFF I TOLD HIM THAT I COULDN'T. HE SAID, WELL IF U DONT I'M GONNA HAVE TO LET U GO THEN!! AND I SAID OK. i SAY TO MY SELF THAT'S NOT FAIR, 2 OF THE GUYS THAT WORK IN THE AFTER NOON HAVE THEIR EYEBROW PIERCE TOO... WHY WOULD HE SAY THAT TO ME... CAN I REALY GET FIRED FOR THAT????

The answers is...it depends. If your company has a policy which prohibits visible piercings, then you could be terminated for violating that policy. However, it appears that two of your co-workers have visible piercings, so there is obviously no policy against it, or the policy is not enforced.

If you are fired for this and your co-workers are not, then you are being discriminated against and you may have a claim.

It depends on the dress code (written) and the nature of your work. You need to look up your policies and procedures before you challenge it, and also, think about whether it is worth it or not. I know you don't like to hear that...but many of us have learned the hard way, sure you can sue...but do you have the resources to do so and is it a big enough issue that it will make a difference in your life and anyone elses? The bottom line is an employer can require you to adhere to anything that isn't discriminatory. That is actually a very narrow spectrum and limited despite what people think. The fact that he allows piercings to be worn by others is questionable. Like I said, do your research before bringing it up.

What state do you live in? If you live in at "at will" state you can be fired at any time for any reason. The Employment At-Will Doctrine means that employment is presumed to be voluntary and indefinite for both employees and employers. Another common misconception is that your employer cannot treat you one way and someone else another. Unless you can prove a solid pattern, IE only firing women or Hispanics, then they can treat individuals anyway they like.
