We live in Indiana and I have sole custody of my son and his father only has visitation rights. We were never married, he filed for paternity originally. Is he required to tell me if he takes our son out of state? I know I'm right, but need to find documentation somewhere.

The court order says "custody is to be with the mother and the father is to have the right to reasonable visitation". This is his year to have him for Spring Break.

Sure is. He better have it in writing and notorized and with him at all times. Or you can have him charged with parental kidnapping (federal offense) without it and once he crosses state lines, hes open game. But hes required to let you know where hes taking him at all times on road trips

First off does he have visitation or joint legal custody, meaning he has set visitation and is still considered non-custodial, but he has equal rights as a parent?
In this case he would be able to take him out of state, for vacation or whatever, but it would be with your permission first. The same would be true in your case, you would have to notify him. You would need to consult your court order, if you have one.
If the visitation is simply voluntary, and he doesn't have a court order, then he would have to have your permission explicitly.
Either way you would know about it.

You should require him to tell you. Is there a court order on file? You should know where your son is at all times, and he should tell you if he takes the kid out of state so you don't worry excessively.

Unless you have a very weird custody agreement, absolutely he's required to inform you if he's taking your child out of state. Since he doesn't share custody, it could also be considered kidnapping, and since he's crossing state borders, it would be federal kidnapping.

Hi, of course he is responsible to tell you, you have full custody of him, you are required to know at all times where your child is. If something which to happen to your son then what will happen then. You tell him if he can't respect that then leave your son their with you.You also have the right to know who your child is also around. Take Care

It should state something to that affect in your divorce decree. If you have sole custody then I think it is only fair that he lets you know, just in case of an emergency. My ex has to tell me and I have to tell him if either one of us takes our kids out of the state. It is in our divorce decree. I have sole custody of our boys.

Custody orders will answer that question for you. They vary state to state and case to case.

Yes, he most definently does. If he doesn't by law that is classified as kidnapping reguardless of his intentions.
