My sister has custody of her 3 daughters in NY State & has been offered a good job elsewhere. How far can she move her family? Her husband has them every other weekend. Any insight or tips/links would be greatly appreciated. Thank you.

If its out of state, she will have to get written notorized permission from either the Dad or the courts, whichever is easier to obtain. Without either one she runs the risk of being arrested and charged with parental kidnapping (federal offense across state lines) and a real good chance of losing custody of the children. You have a good reason to persuade the courts but needs a plan for dads visitation rights and needs to show that this will also be beneficial to the child too. Good luck

That depends totally on what the custody agreement says. Most states do not allow the custodial parent to take the child more than 100 miles away from the other parent without the other parent being notified and consenting to the move.

she needs to sit down and have a talk with her x husband. usually the spouse does not like it and will fight it in court. It is just not fair, to pick up the kids and go....The children need both parents.....But more than likely, the husband will not go for the idea and there may be a battle in court over this.

usually you cant take them more than 100 miles or out of state, for the person that said to just tell the dad and leave-if this was the other way around would you still say that? the dad just should take the kids and leave? both are kidnapping, you cant just take the kids and go

Agree with the others, the divorce papers will probably specifiy how many miles limitation she has. She should consult that first, then contact her lawyer about the issue.
