My mother is Unfit to take care of her children. They are ages 10,9 and 6. She and my stepfather divorced and even though he was severly disabled he provided them with a good stable life and they remained almost solely in his care. The courts awarded them joint custody just because of his disability but would not award her full custody under the GAL verdict that she is "mentally unfit". Unfortunately my stepfather with whom i was very close to passed away last month. Since then she has continued to live in a horrible lifestyle with the children. She lets her boyfriend sleep in their house, she doesnt cook them meals or buy food, she has no job and is irresponisble over all. She is 37 yrs old. I am 20 and due to her inability to raise children properly i spent a good part of my teenage years raising them myself. All of them have stated they would rather live with me and i dont feel she could give them a decent life. Is it possible for me to get custody of them?

I think you definitely could get custody. The first step is reporting her to the proper authorities and making a claim of neglect. Then, work with the social workers on the case. Your mom might be relieved to have you taking care of the kids!

If you have a job and some money yes you can get custody of them. Ask your mom to let the kids come spend the weekend with you. Ask the kids if they want to stay with you or their mother. If the kids say they want to stay with you then first thing Monday morning go to a lawyer ask for an emgerancy child custody hearing. YOU MUST HAVE THE KIDS IN YOUR CUSTODY. Within a few days you will go to court.

yes it is...get a good lawyer
If you turn her in to child protection they will more than likely take them from her and separate them in foster care and in some cases that can be worse than the situation they are in now.
Will she sign them over to you voluntarily? If not, go get yourself a lawyer and file a custody suite against her.
It takes a lot to prove a mother unfit...if you can do that then there is a good possibility that you can gain custody.

be cool...

You need to turn her into CPS and go after custody or guardianship of your siblings. Sounds like you have been there the most for them.

If you and your lawyer could prove her unfit, I bet you COULD get them, and it sounds as if there isn't any doubt on getting the evidence you will need.
