I like how Adderall makes me feel so I tried getting prescription at my doctor office. I told him I had ADD. He was in the middle of asking me a question and I blurted out "Meatloaf on funnel cakes mixed with sponge bob squarepants and a supernova".

He said that this behavior is more indicative of psychosis than ADD and basically told me I was pulling his chain. He then stopped the appointment. What can I do to sue him for malpractice and discrimination?

You can sue anybody for anything. Hire a lawyer (you will have to front your own money). I recommend you get the most expensive one you can find and pony up a big retainer, say $100,000 or so.

Give him all the information you have and tell him you want to spare no expense to sue this doctor.

That way, when you lose, you will know you did your best.

First of all, this isn't legal advice; since basically you don't have a case. This is just pointing out how you seem like a fraud based on the story you told.

If you want to do anything, you thank him for possibly saving you twice over.

Secondly, the way your story goes, it appears that you may only want the substance for a high.

Next, do you actually have ADD? Unlikely; As you can easily recall the details of your conversation, as well as what you said. A person with ADD wouldn't have been able to recall such details easily with the attention you obviously gave to your medical practitioner.

Lastly, It seems like you have Tourette's Syndome, and if you do, taking Adderall will only enhance your symptoms.

"Adderall can make tics and twitches worse. If you or a family member has this problem (or the condition called Tourette's syndrome), make sure the doctor is aware of it. Amphetamines such as Adderall have also been known to aggravate symptoms in seriously disturbed (psychotic) individuals"

Since you gave all indications that you were one thing (psychotic) and not the other (ADD prone) he was justified by his conclusion (pulling his chain) and he did you a favor by not giving you anything but the door. He was not obligated to assist you further as he is not trained in those sciences so he was also not liable to send you to a shrink because he is not qualified to diagnose you.

[The case was a malpractice suit brought against Nordhagen, a chiropractor, by a patient who alleged that the chiropractor had failed to properly treat her herniated disc. Specifically, the patient accused the chiropractor of failing to refer her to a medical doctor for diagnosis and treatment of her condition. The court upheld a dismissal of the suit on the ground that a chiropractor "does not have a duty to refer a patient who is not treatable through chiropractic means to a medical doctor." (588 N.W.2d at 99).]

Although this ruling may not be where you live, nor is it dealing with mental issues, I have visited other sites and the conclusion appears to be concurrent. The second reason I am not posting any direct links that deals specifically to your "case" is that if you are faking, I will not help anyone gain access to telltale symptoms.

Now someone may argue that the most severe manifestation of chronic intoxication of Adderall is psychosis, thereby giving the appearance of him holding a liablity towards you, but since he's not qualified to specifically diagnose you through his training, again, he is not liable.

So no, you do not have a case. You are lucky he didn't turn YOU in to the cops, thereby saving you from Bubba's sweet, sweet embrace.

He could have turned you over to the district attorney for trying to get a prescription under fraudulent means.

this did happen here, and the person doing it had a jolly old time in the county prison.

You can't get a prescription just because you "like how something makes you feel" Your doctor has his butt on the line to only write necessary prescriptions. If he wrote a script to every quack who comes in his office wanting to "feel good" he would end up in jail

i think you may have a case. your dr. discriminated against you for being in good health. you probably feel pretty good most of the time but he denied you the drugs that would have made you feel even better. that's a crime! you shouldn't have to wonder if you're suffering from mild discomfort or not. get a good lawyer, you know, the kind that'll sue anyone for anything and until your case is ultimately decided in your favor you should probably obtain all your pharmaceutical needs on the street where they don't ask so many questions. good luck!!!

Nothing. Your doctor acted in a very professional way. He thought that you were a kid trying to get a drug from him to make you feel good--which you are--and he used his professional judgement when he kicked you out of your appointment. I give kudos to the doctor.

Do you truly have ADD? If not, then he was not out of line. If you do, then yes he was, but you need to get a second opinion on your medicines.

Spouting gibberish is Tourette's Syndrome. I think your doctor has the right idea but he really should have sent you to a psychologist for further testing.

Nothing. Do you know how much trouble he could get into by prescribing medication he knows you don't need? He did the right thing. Sorry.
