The paitent is going to a mental health facility.

You did not indicate whether or not you are a psychologist or therapist. If you are employed in the mental health field, it is unethical for you to have a relationship with a patient or client. In some cases, you are risking your license to practice.

However, if you are not employed caring for a patient, and the relationship is consensual, it is a matter of choice.

I am guessing that you didn't pay attention to the topic of medical ethics? Ethics related to your job and legal are two different issues.
The other issue is that of not always recognizing issues (such as delusions, distortion, so forth) in someone with mental health problems. TRUST me on this one.. I am the parent of someone with severe bipolar, but she can be charming as hell to someone who doesn't know what she really is capable of.

Yes it is illegal to have any relations with a patient at any time as long as they are under your care. In a Mental Illness atmosphere the issue can be worse due to the fact they can state they were not in their right state of mind as of the person with the medical knowledge is suppose to be.
