Depends on the person and the situation. ;-)
The difference is that when most people use the phrase "make love" it often has more romantic connotations in their mind whereas "have sex" could apply to a one night stand or a fling.
Which term do I prefer? Well.... I'm going to have to agree with Praetorian on this. *grins*

Love making is a body-contact sport. It is safe to watch but more fun to play. Whereas sex is like air; it's not important unless you aren't getting any.
The difference is the labelling.

It does depend on the mood. At times my husband and I like to make love. But there are those times when you just want to get down and dirty and have sex.
