Anyone can be sued by anyone else at any time for any reason.
However, you cannot get blood from a turnip, and there is no way a court would touch Social Security income to pay a judgement.
The credit card company is out of luck.

Just tell her to call the credit card company and pay them 5 dollars a month.Even 2 dollars a month. As long as she is paying them something. Credit card companies choose the most vulnerable to scam anyways. So its not like they care about the financial situation.
Its like when a predator mortgage company gives a home equity loan. They will give the loan out just so they can foreclose on the property when the person gets in financial troubles again. They are all criminals.
As for you, sow a seed in a local church of 100.00. You will be suprised of Gods blessing.

I think the answer is that you can sue someone but you will never get them to pay, because they don't have the money.
The credit card company is using the law as a threat. If there is a problem they can sue over, then they have an obligation to first sit down and discuss.
If you don't have the money to pay, you don't have the money to pay. So smile, be polite and keep telling them this.

Credit card companys can harrass you and send your bill to a debt collector, but can't sue you But the government can sue if it had a need to it happened recently and they put it on the news because the man only collected soc. sec. and owed a student loan

They can bring the lawsuit forward, however if informed of her financial plight, they probably won't. This won't stop them from going after any assets she might have though, like a house or something worth $. In the end, they will probably send a nasty credit report filed under her name and her credit searches in the future might have an ill bearing.

maybe the credit card company does not know that she is on SS, for all they know she could have other income and/or things like a pension, IRA, property ETC.
