Well it depends on the jurisdiction, because different jurisdictions will have different definitions (through legislation and case law) of what is discriminatory.

For foreigners and people of foriegn extraction, then it is not a big legal issue because most laws explicitly mention ethnicity.

For the poor, there is often no specific legal protection.

To prove discrimination then there probably would have to be a pattern of malpractice, not a single instance, to prove the discrimination.

Malpractice suits are against doctors or lawyers. Neither doctors nor lawyers are poor. Neither can get certified in their respective professions without passing exams like everyone else here. Actually the foreign doctors certified here must get higher scores than our American doctors. So, a lawsuit against impoverished or foreign doctors or lawyers for discrimination makes no sense.
