Legal separation is used when a couple or one of the people in the marriage wants immediate legal separation from the other. So the minute you do the paperwork and file it at the courts, you will from then on not be legally tied to one another. If you have children it gets a little messier. Basically it protects you from your spouse gaining more debt. And you don't have to be legally separated, its a choice and you can be legally separated for any amount of time before your divorce.
You can do legal separation through a local paralegal. Look in your phone book and you will find paralegals that will draw up the paperwork for you and at a discount rate compared to having a regular lawyer doing the paperwork. If you have a regular lawyer do the paperwork you will be paying them their hourly fee plus filing fees with the courts.

You don't have to be separated to be granted a divorce. There is no reason to go through the process and expense of a legal separation before getting divorce.
Just go see a family law attorney.
