GardwineNorth is refusing to allow our local community store to pick up there own freight (groceries) from the distributor. Distributor is in Wpg. Mb. Canada and our little store is located in Northern Mb. The distributor has stated that GardwineNorth has that right not to allow anyone else to pick up freight? How can they have that right? The cost of shipping goods to the north is very expensive. We own a truck that can deliver the goods and would bring the cost down. We would also employ one of our residents to do this work. Is there legislation that allows them to do this? Is the distributor being un-fair? What are some options that we have to go against this Corporation that is Not allowing us to pick up our own merchandise. Is the distributor doing an illegal act by allowing this to happen. your help would be greatly appreciated as to where or how we can resolve this matter.

You're very confused on how the law works. As was stated above the question should be is there a law that prohibits them from doing this. Of course there isn't. The company always gets to choose how to deliver the freight. What would stop you from demanding the item be sent FedEx instead of some other carrier you like to use.

Next you also have to consider that for liability purposes they might not want you on their property. (ie it might not be setup for trucks other then those they use or no where for an individual to safely load/unload the frieght there.

The don't need legislation to ALLOW them to do anything. The question should be "Is there legislation to PROHIBIT them from doing it or REQUIRE them to do something else?" That said, the freight is NOT YOURS until you comply with the terms of sale. If those terms include ACCEPTING delivery, you don't have the right to pick up the merchandise. Your options are to BUY FROM SOMEONE ELSE. Fair and legal are unrelated concepts. Fair does not exist in the real world.
