how long does a parent have to be out of a kids live before the step parent can adpot the kid without consent?

my daugther's mother has not talked to her in over a 1 1/2 years i was just wanting to know how long before i can adopt her without taking her mother back to court for her to sign her rights away

Unless she signs her rights away, the only way you can go would be to prove abandonment.
