It is unlawful for law enforcement to arrest only a select few from a crowd of lawbreakers unless they arrest the ENTIRE CROWD... That's how people/cities get away with having pot festivales too. Say there's a crowd where there's 200 people smoking pot. If they just arrest a few or say 50 of those people, then the ones who are arrested can claim discrimination and sue them for letting the others go and picking on just them. The only way around this is for the cops to arrest 'everyone in sight' and only then could they make the arrests stick. That's why when they break up a protest, they go in and grab anybody and everybody. It's much easier for them to just make their presence known and as long as nothing gets too out of hand, no one will get arrested. :-) great question!

You have to have reasonable suspicion that they are actually smoking or possessing pot before you can arrest them. Just because you listen to marijuana themed music or where pro-cannabis t-shirts doesn't make you guilty of drug procession.
You still might be profiled and interrogated by the police on the street, but they won't arrest you until they have some evidence linking you to a crime.
