The best thing is to consult with a lawyer so that you know what you can expect from a lawsuit and whether or not it can achieve your desire to have the problem fixed. Most lawyers will give you a free consultation, and they will give you the right advice.

I am not a lawyer, and I thank God every day for that...but I think you might find out that a simple crack in the ground may not be anything you can sue for. It would have to be something that was so completely out of place as to make it an obvious source of liability via the city. Consider this:
A kid takes his father's ball peen hammer and cracks your sidewalk. Nobody notifies the city, so it is not fixed. While walking your dog fluffy, your flip flop catches in the small crack and you fall down and break your crown. The city probably cannot be held liable since they were never notified and could not possibly know that some kid cracked the sidewalk, true? However, lawyers have sued for less and won, and OJ is still free. So anything is possible.
Now suppose that you called the city several times and they refused to fix the walk. The same scenario occurs when you are walking outside and the streetlight is also broken. Well then you probably have a better case.
Oh well, I still dislike lawyers...lol

Just because you sue does not mean it will ever go to court. The city will more than likely settle out of court. You could make this part of the settlement of the lawsuit, that the crack be repaired along with the payment of the hospital bills, and the pain and suffering.

you can sue them and get your damages covered, but put a clause that states they have to correct the area in the ground that needs to be fixed. This will take care of both you and future people. All stuff aside if you are out for medical expenses you need to speak to a lawyer that will do the case on a contingency basis this means they don't charge you unless they get you a cash settlement.

You can always sue just requesting the injunction, to force the sideway to get fixed, but without asking for damages.
Or just ask for reimbursement for out-of-pocket medical expenses and court costs, but not pain and suffering.
Those (the first more than the second) reveal your motivations.

you should sue and petition. You got hurt because of their carelessness and you shouldn't let anyone else get hurt either
