They are generally looked upon as separate issues in the family court system. You can petition for visitation rights even if your child support is in arrears. Just keep in mind that the judge may not look as fondly on you if you are behind.

Child support is determined by the court, based on the laws of the state and a formula that provides the total cost of living for the child and the ability of each of the two parents to pay.

Visitation is part of child custody, and is based on who has legal and physical custody, and determinations by the court of how safe and competent each parent is.

I have a hard time with your use of the word "have"... as in, "have to pay child support." A parent's responsibility is to provide for the care and upbringing of their child. They don't have to like their child's other parent. They don't have to live with them or agree with them, but they are morally obligated to provide financially toward the care of their children.

One is not dependent upon the other.

The non-custodial parent MUST pay child support whether there is visitation or not.

The non-custodial parent has the LEGAL right of visitation whether child support is paid or not.

It depends on the other party. My sisters ex husband hasn't been paying child support so she refuses to let him see the child until she receives some sort of compensation. It depends on the state and local laws, and how much custody was awarded to each party.

visitation is part of the custody agreement and just because the person does not pay, that does not take away any of thier visitiation rights.

they are right, child support and visitation are totally two different issues, and handled separate in court.

neither one is conditional... they are rights.

if denied visitation, they get in trouble, just file a motion to enforce visitation.

if denied child support, the payer gets all sorts of things done to them by the state/federal gov. they are TIRED of people not paying for their children, and passed stronger laws.
