That what evidence and witnesses are for.
The prosecutor attempts to prove it was him, beyond a reasonable doubt. Then the defense either attempts to discredit that evidence, or present their own evidence, to create reasonable doubt. This might include the defendent testifying.
The jury then decides who to believe, and whether the prosecution has sufficiently proven its case.

We call it evidence...eye witnesses, blood from the victim or defendant found, items of the defendant found at the scene, video tape of the crime, habits of the defendant, lack of alibi, motive, murder weapon found on the defendant....use your imagination.

because of something called evidence and witnesses and lack of proof of where he was, they could bust him or her in a lie, and so forth, don't you watch anything with court on it

um...so...he would lie.............that's the point of a jury. to decide whether or not the criminal..oops im sorry i mean "bad person" is lying. haven't you ever seen cops shows...such as law&order....or the practice....try a little less "E!" and a little more "A&E."
