All you can do is to sue the contractor. Make sure you have all of the evidence on paper, what the contract was and photos of what condition the job is in now.
Good luck with it, because some fly-by-night contractors will just bankrupt their company and start a new one to get around a lawsuit, or they may have very few assets that you can win in a judgement against them. Sometimes just the threat of a lawsuit will get them to finish your job to avoid the hassle.

If you had a contract with a "Contractor", he has to perform according to your agreement. That is the basis of your legal action. "Failure to perform." A contract is an agreement reached by mutual assent, in which you agree to provide "Consideration"( something of value), in exchange for a service "Performance." If you did your part, and he did not work, you have recourse. You must give the conractor an opportunity to perform in writing. Failing that, go to court.

Hopefully you have some documentation (a contract or work order) that clearly expresses the work to be done and the amount it will cost. If you have these then it would be best to go to small claims court to settle the debt either way the small claims court would be the way to go unless you are talking about a large amount of money. If that's the case contact a lawyer.

call and report situation to state liscensing board, bbb and local homebuilders assn. next file suit in small claims court. take pics. keep all records(contract, payment records). if full payment hasnt been made, good. if it has, you learned a valuable lesson the hard way.
