I really don't think I should, but no I am having doubts...my husband and I are getting leagally seperated. He is in the military and I know someone will be there for him. He says that I can get a lawyer if I want, so it is making me wonder....

OK, thanks guys...now I am really freaked. I said we are getting seperated...not divorced. Of course that is a possibility but it seems that most people take getting seperated as just the thing right before divorce.

You should consult a lawyer. Even if you don't hire one you should understand fully what a separation in your state means, what he has to do to file for divorce and what your rights are during the separation.

You would be surprised how many people are uninformed of their rights in such a situation and are taken advantage of and if a divorce actually happens they are left in a bad position.

Since you are a military dependant until you are divorced you have the right to use a JAG lawyer...contact the JAG office at the military installation nearest you to consult one for free.

Lawyers can do two things -- help you sort out the legal hassles that may be involved, or cause things to become very messy.

Some lawyers are very helpful, and have your best interests at heart. A few are adversarial, and like to win at all costs. While this few are rare, they can make things more difficult.

You may want to consider family/divorce mediation before getting lawyers involved. A mediator has no agenda beyond helping you sort out the legal issues, and doesn't take sides.

The only people who are going to come out ahead in any divorce proceeding are the lawyers.

It really depends on what you may have together, but, as distateful as lawyers can be, if you are not represented and he is, you may well regret that choice. Find a good one and ask, it is usually free to talk the first time.

Well Courtney, I am a lawyer and I certainly recommend that you get one. Whatever goes on in court could affect you finanically. And, if you have kids you should protect your rights there too.

It is yes if you have kids, assetts, do you get half his military pension? Some sort of alimony involved?

you should get one..too keep yourself from future troubles..you may not know..the in's and out's of divorce settlements. Be strong!
