No. Unless you can demonstrate that the accusation was in bad faith.

A Civil Action would require you to show damages incurred by wrongful act of defamation.

The cops dont care usually. They just need the easiest person to blame. I got accused of arson because some punk I got in a fight with earlier in the day, said I burnt down his house that night at 8 oclock.When his family mysteriously left for an hour,according to the news paper. I had to take a seven hour polygraph and passed with flying colors. To this day the criminals have gotten away with it. They started to blame me from the minute it happened. They recieved over 300k in insurance money and also money from a fundraiser. Its terrible that since I didnt do it,the police have just forgotten about it. I even talked to the detective two years after,and he tells me God knows what they did,and the man upstairs will take care of them. They knew they did it, but I highly doubt the criminals ever took a polygraph or they wouldnt have a free house at the expense of my reputation. I live in a small town and that makes things even better. Thats only the beginning of the corruption I have had to deal with.
I had a choice to sue them,but I figured the justice system would take care of them. Money had nothing to do with it. I would just like to see justice served sometimes,and not be the victim of deceit. But I was wrong and I should have sued them to the fullest, because the justice system is corrupt and practically worthless. And things have only gotten worse since then.

Generally, no.

Filing formal charges is normally immune to defamation suits.

If the other person held news conferences, or posted their claims on their website, that's potentially a different story. But your lawyer would have to prove bad faith -- that the person didn't actually believe the claims. And that's very difficult.

Yes, you can bring a civil suit against anyone at anytime for anything. Will you win? that's another question. There is also always Slander, defamation of character, laible, etc.
