If you can prove it, you can sue ... and win. In fact, if it's deemed a hate based crime, many states stiffen the penalty.

Generally, only for racial discrimination.

While the 14th Amendment protects against many types of discrimination (including race and religious), it only protects against government sponsored discrimination, not private.

However, pursuant to the 13th Amendment and the Commerce Clause, Congress passed laws banning all private racial discrimination in any commercial establishment. So, that created a private right of action to sue the business.

That would be against the LAW unless you start to pray in the middle of the restaurant and bash America then you have the right to get your *** kicked by everyone who is offended.

Only if you can prove it; best bet would be to secretly video tape them and then try to approve your assumptions; albeit, if the end result for your being denied service proves via the tape is due to your inappropriate behavior, that is what is known as SOL.
