This is a follow up to my previous question - Now comming back to my question - I married 4 years ago with no dowry, infact bore the entire marriage expenses, when my wife was tested positive for pregnancy she want my child aborted, then she tried her best for misscarriage then after my child was born he was never breatfed, she and her folks have swindled me off over Rs35 Lacks (aprox US$70,000/- big money in India) and when I refuse to pay up any more she simply empty my house in my absense mover everything into her fahter's house, try to empty the locker which she could not since I had already frozen it. I tried my best to convince her when I could not, I sought help it never helped then I went to the court seeking restituion, instead of trying to help me the Counsellors hear only her story not mine and keep accusing me and asking me to accept all her terms and conditions dispose my parents, my career ie basically to become her and her folk's slave - isn't this Mockery to Justice??

Firstly just tell me who advised you to seek restitution of conjugal rights from your wife if she was doing all such misappropriation of your property. On the basis of all her misconduct the best course for you to seek divorce from her on the basis of mental cruelty rather doing so you went & asked for restoration of conjugal relationship with her. Had you gone for divorce those very Counselors would have come pacifying you & requesting you to keep her rather making you to accept all her terms & conditions. You guys go & engage wrong Advocates who just misguide you & make you to file wrong suit in the court & then you start blaming Judiciary & judicial system. My dear friend just going by name of any Advocate/lawyer does not mean that you are sure to win the case, Just for the information of you & all others only recently India’s greatest Criminal Lawyer Ram Jethmalani took Manu Sharmas Case the famous Jessica Lal Murder Case in the Delhi High Court & every one started thinking that now no harm can come to Manu Sharma as such a famous lawyer is defending him but in reality what happened? Have I to tell this to anyone now. Your approach to deal with such a wife in the court itself was wrong. Now stop blaming the Judicial System for your own wrong approach.

No. In your situation, this a repercussion of strained and reckless matrimony. Unless there is a criminal breach of marriage, perhaps you can't take any legal action and thereby recourse to law. Best way to settle this issue amicably is to divorce with mutual consent and quit. Otherwise try to seek help of elders of both families to resolve the issue.

In a very recent landmark ruling, the Supreme Court of India has ruled that if a wife inflicted mental torture on her husband, he could seek a divorce on that ground and be granted the same. The Supreme Court has also cited very specific instances which constituted mental torture. I think that all the incidents that you have mentioned makes it a prime case of mental torture of wife on husband. i think u must go for a divorce, may be thats not the solution for the problem, but how can you manage to stay with such a insane person who is undoubtedly behind your money......well everything will be fine....gud luck
