I have three 12-round pistol magazines that I bought in Kentucky that I would like to take with me when I get out of the Army and go back to California. As I understand it, the legal magazine capacity under California state law is 10 rounds. I would like to know if I would be allowed to keep them since I bought them legally in another state, or if they would be illegal to own in California regardless.

They are law enforcement and military use only. I was able to buy them since I'm posted in Kentucky on active duty in the military.

Oh yeah, I brought back a 500 round box of 30 cal ball for the M60 I hung out with in 1970 hovering above some cra* real estate. I'm sure that I was able to keep it cause it came from somewhere else.

Sorry but your question is just so.........well, youget the picture.

Technically speaking California has a lot of really stupid gun laws. But that aside, its probably illegal to import a magazine into the state unless its for law enforcement or military purposes. Even if the magazine is marked for law enforcment/military.

On the other hand, I also understand that there is an exception for magazines manufactured before the ban.

I would guess the serial numbers etched onto the magazines would tell the story as to when they were manufactured, and if so, if its before when the California ban went into effect its likely legal if its being reimported into the state if it was lawfully possessed there before the effective date.

At this point it sounds like "hit n miss"

Anyway, go look at the law: CALIFORNIA CODES
PENAL CODE SECTION 12020-12040

First of all, if they are for law enforcement and military use only, when you get out and go back to California, you will no longer be in the military. As far as where you bought them, I m afraid that it will not matter in California that they were legal where and when you bought them. Else, any person in California who wants to own an illegal weapon can simply go buy it wherever it is legal to do so and bring it home. In that case, the California laws would be pointless.

Although I'm not up on the specifics of law in California, in general you should be allowed to have them, as you bought them in another state. Are they pre-ban, or are they marked "law enforcement use only"/ if pre-ban then you could claim to have owned then for a long time, if caught with them.

Check with the NRA. In some states if you have such magazines you can make them legal by installing a device that blocks the excess capacity.
