Can I act as my own attorney and file paperwork with the court ?

Yes, and the court clerks will help you just as they help the lawyers. But you should consider that your kids still need to be fed and clothed. Why don't you get another job?

Depending on what state you are in, some states will allow you to file your own paperwork and other states require that you contact your local Child Support Enforcement Agency with an update on your income, they will request the required paperwork needed to decrease your child support. Keep in mind that each state have rules that they go by and the child support may not be lower until you are out of a job for a certain period of time.

You can do this yourself by petitioning the family court in your area to decrease your child support. But as a mother who relies on child support to pay bills I would suggest to you that you try to get a job as soon as possible and not worry about getting the decrease. When you create a child, it is both parents responsibility to provide for that child, so get back out there as soon as you can. If you are making less money, you can still get a decrease order. Just because you lost your job does not mean that your child support should be decreased in my opinion. The same expenses exists for your ex raising your children. They still have the right to go to university etc. Think about that first before you try and petition the court. You are taking it away from your children!

Hi , Yes you can but it always best to have one you can call and get advice from, alot depends on the state you are from and are they man friendly or female friendly!!!! The reason I say this is because I just went through this with my son's father, He lost his job and couldn't pay and the courts here don't care they want MONEY MONEY MONEY that is all they care about !!! So to fix there little red wagon we stopped his support all togeather !! And to show how greedy they are he owed 6.35 , we had the 6 dollars but not the rest and untill ALL of it was paid they would not drop it !!!! So good luck to you and wish you the best

Now here is a thought! Your friend could get another job! It is his child...does he really want to screw over this child...a child who had done nothing to him but be loving? Sometimes I wonder what in the world is going on in the minds of some people. This is a very sad statement.

just tell your friend to call the caseworker and request a hearing for review.... because of the changes in his income (lost job). he just needs to bring proof that he lost his job, and proof he applied for unemployment.

payments wont stop, or be lowered too much, but its worth a try. you see, the courts sole job is to make sure the child is taken care of.

they are going to put you in arrears.. the courts will make you get two jobs to pay your obligation. they will also take 65% of your unemployment...
it's not worth going into that much hock because you'll never recover. you'll be considered a deadbeat dad and no one will hires you
