I don't want to claim the design as my own but use it on a T-shirt, and maybe...just maybe have some printed up and sell a few......not hundreds, just a few. Where do/ would I stand on this.

None. It is illegal to alter any copyrighted item.

You may be going beyond copyright law and trespassing on Trademark law - the rules are much more strict in that a design can't resemble or even suggest the original trademark at all.

If you want to do a couple of shirts for your friends you're probably safe, but if you sell just one, you could be in trouble. Chances are their lawyers are meaner than yours.

Basically you are not allowed to use someone else's design without their permission, it is no excuse altering it a bit as you would still be using the original design.
If you want to do it legally, get in touch with the copyright owner.

Here's what the US Copyright Office has to say:

"Only the owner of copyright in a work has the right to prepare, or to authorize someone else to create, a new version of that work. Accordingly, you cannot claim copyright to another's work, no matter how much you change it, unless you have the owner's consent."

If it's copyrighted you would have to be sure that your new design could not be mistaken by anyone for the original.
At which point it would be completely different any way!
