War can only be declared by Congress as per the U.S. Constitution.

The sending of military aid to help overthrow a government is an "illegal war".

"War Crimes" are acts so evil and shocking that the cause moral outrage. The term can also be used to describe anything not permitted by the Geneva Code.

According to our Constitution, Congress must approve a war for it to be legal. Traditionally, in European culture a formal declaration of war must be made to make the war legal.

Previous to Vietnam.....

For it to be considered a war there had to be a formal decleration of war by the president and that it was ratified by a 2/3rds majory by the house and senate.

Vietnam was where that idea got turned on it's head. By not calling it a war, but rather a police action, the president (s) where able to do all the things they could in war but without the formal decleration of war.

Nowadays.... A war is simply whatever the President of the United States says it is. War on Terror, War on Drugs, War in Afghanistan and Iraq, etc.

Nothing that makes it legal, its political necessity and will which is the basis of just about every war. Organizations like the U.N. can either sanction them, or not, but all that amounts to is an expression of displeasure or a thumbs up. Nothing more.

One would have to assume it would requires some body with jurisdiction on the matter to rule it illegal. For example, for the Iraq war to be illegal it would require a ruling by the UN Security Council or the US Supreme Court.

I know it is rediculous but if the president and congress say "go to war" then we go to war. Are you talking about actions within war? Like, you aren't supposed to bomb hospitals?

Anything that Bush did is illegal and anything the opposite of Bush is legal. I hope this helped.
