I am going to be in a Rehab clinic for 3 months and wont be able to appear for this Summons, I am a wtiness to a crime that was committed, its not against me, but is there any way possible that i could perhaps write them a written statement instead of appearing in court, im not sure if theres anyway i can perhaps get out of this so i dont have to leave rehab and all, By the way i live in Virginia if that helps anyone any.

I would first contact a local lawyer to ask how to take care of this process. Virginia is a common wealth state and all laws are different there then a "state" but, most likely you will be able to do what is called a deposition. This is a verbal questioning taken down in writing under oath, and submitted in your place when you cant physically appear. Good luck

Have the Director of the Rehab Facility write a letter to the court on your behalf explaining the situation. Then it is up to the court. They still may decide that you have to show anyway. Good Luck.

You must contact the court and the DA's office imediately. They might be able to arrange an affidavit be taken, so you will not have to appear in court.

Tell the people at rehab your problem.They deal with this very often.
