I was passing a car in a 55 mph zone in the left hand lane. The highway is 3 lanes wide. There were approx. 20 cars around me. The officer said they had me going 84 mph. She asked me how fast I thought I was going I said 90. In New York State, I wasn't aware that they were going to log into my ticket what I said. I wasn't read my miranda rights either. I realize that radar can be very inaccurate when there are multiple cars. How can I argue that I wasn't speeding when this goes to court?

Actually I wasn't really paying attention to the speed I was going. My speedometer reads 10 mph faster than I'm actually going. I was originally in a 65. And I was probably only going about 5 mph over the car to the right of me. There were cars in front of me going much faster.

As soon as I overtook the car I slowed down to his speed and went into the middle lane. The cop came right up behind me, with no lights on. Followed me for a little then decided to pull me over.

I would first consult a lawyer in your local area. Some in matters just like this will give you good advice. Also I would demand that the radar guns last inspection be submitted. Every state is different, but most require a monthly if not quarterly check. If it is close to the time it should be checked then ask them to test the gun, she used. Also ask them to show you what type of gun it is. Different types of guns read in different ways. Exapmle some go by a pulse that is transmitted from the transmission which the car then translates to how far you have gone etc. If it is one that reads this way have them provide you the information that it read your car and not the ones surrounding you at the time. A machenic will be able to give you the exact name of what that reading is called. Also several cab companies use the same readings to tell the meters how to charge passengers so a local cab company can help you with the name of the type of readings as well. Hope you win

Uh... but you WERE speeding.. 84 miles an hour is way over the 55 mph speed limit. That's dangerous as heck driving that fast, you deserve to get a ticket, especially because it was 29 miles OVER the posted speed limit.

Next time try passing someone and still staying under 70, they might have let you slide.

You have already admitted to speeding. Why in the world would you tell her 90mph?

Radar can not pick out a certain car. The cop has to judge which car was shot The one passing is a good victim and the highest profile vehicle is usually the one that gets pulled.

you're no longer allowed to velocity on a 4 lane hwy - even to bypass. the only time they supply you a buffer for dashing whilst passing is on a 2 lane highway, so as which you would be able to wisely get lower back into your lane in a real looking quantity of time. you will desire to objective to dispute the value tag in courtroom, yet maximum in all risk you will lose. Miranda rights are not necessary for a speeding ticket. I see no way for you to prevail. That is some pretty strong evidence.

I wonder how one could be speeding while overtaking or passing a car in the left lane without maintaining adequate distance! If done so, it could lead to an instant fatal disaster!

Wait, your going 90 and told them, and now you want to argue that factor? Am I reading that right? Either show up, and hope the cop dosn't, by the third time, they usually let it go, but if the cop shows, your screwed.

you cant you were speeding you admitted it. you dont need miranda warnings for tickets you were not arrested. pay the fine and slow down
