I was charged with speeding on the freeway at a time and place where a speed limit sign was required to enforce the law, but there was none posted. So, I went to court to fight the ticket and lost. Now, I'm going to appeal with the support of the National Motorists Association. After my case is overturned in the Court of Appeals, it will be official that the speed limit cannot be enforced on the expressway at the time and place speed limit signs are not visible.
You know what this means? Speed traps will disappear everywhere except in front of speed limit signs. I know that interests you!
So, these are my two questions:
1. Will you please help me with this cause and donate legal money for this battle? Just think of how much money a speeding ticket would cost you!
2. If you're a lawyer, would you be willing to fight the case with me?

I'm not ignorant of the law. The law actually says that the speed limit should not be enforced if at the time and place of the alleged violation a speed limit sign is not in proper position and able to be seen by an ordinarily observant person. I'm not disputing the fact of a speed limit, I'm disputing the fact of WHERE the limit can be enforced.

I'd also like to add that I'm pro-safety. The facts show that differences in speed are more dangerous than the speed itself. For example, everybody driving at 75 mph is safer than one person driving at 75mph and everybody else at 65 mph.
We all know that a large number of states in the USA have speed limits of 75 mph. So, I don't see what's the problem other than some stupid laws created for ticket revenue NOT safety.

Nope. If you saw a speed limit sign on a highway that said 65 mph, it doesn't matter how long ago you saw it, it's still 65 mph until you see one that says otherwise. Why are you trying to justify speeding? And trying to justify that if you want to go 75 mph, everyone who is sticking to the posted limit of 65 mph is wrong is making the highway unsafe for you, so they should all be going 75 mph too? You're not making alot of sense...
The way I was taught in driver's ed, the speed limits are set according to things like road condition, congestion of the area, and visibility. Alot of research goes in to determining what is the highest safe optimum speed on a clear sunny day.
To say that you want to go 75 but everyone else going 65 is making the road unsafe for you, is just as silly as saying that if you want to go 75 in town where the speed limit is 25, well, that's wrong too, because there are too many buildings in the way, and they should all be moved????

Well you know that you can be given a speeding ticket for driving 20 in a 35 if weather or other conditions make it hazardous to drive at any speed you are driving.
Some speed limits are ridiculously low to create speed enterprise zones paying to carpet small town mayors offices but over all many laws are actually made to protect us. No offense intended but I hope you lose your case. The impact of you winning would be fatal. Can you live with that? I'd drop it, pay the ticket and slow down.

Not only the ones with cell phones or trying to find radio stations scare the crap out of me, but also the ones who are eating and drinking behind the wheel, putting on their makeup or shaving, brushing teeth, reading maps or newspapers, and books. Worse yet, having headphones one while driving. You yourself have made mention that you knew you were breaking the speed limit even though it was not posted. If someone knocked out the posted sign and it hadn't been replaced as of yet does not excuse what you believe is your right to drive as fast as you want. Next you'll claim that driving in or through a work zone at the mandatory 45 MPH imposes on your rights too. Driving is a privilege NOTa right so get use to it!!

Well as you get a little older and have experienced being I an accident you start to realize the importance of safety. Motor vehicle deaths are high on the list of causes of death.
In an instant something or someone can run out in front of you, and you or them could be killed instantly.
I used to drive fast when I was young, then my head went through a windshield.
If you really need to drive fast do it legally with drag racing there are street divisions that let anybody in, on a legal track with safety precautions and you can have a great time.

At best... If we all lived in Disney World as you do.... The Gov. will save a lot of money be not posting any speed limit signs on the expressway and implementing a nation wide speed limit....

No, because I'm a big fan of not crashing my car and dying. You might as well stop fighting, because you're not going to win. Ever. They're not going to change the law just because one person's too dumb to realize that there's still a speed limit where there aren't any signs. You wouldn't shoot a guy and then say "I didn't know you couldn't do that."

I agree with smedrik. The speed limits are codified and when no sign is available, you are to follow the designated speed as defined in the statute for the type of roadway you are traveling on. You also are to follow the last speed sign that you passed.

The flaw its hat when you actually took drivers ed there is a rule that states when a speed limit is not posted you are to travel by the state legislated speed for the style of road you were traveling on.

even though there may not be a sign that says what the speed limit is, you should know that what ever the limits are for the freeway ie. 65mph. that is the speed limit.

Oh my. You were breaking the law, got in trouble and now want the rules to change so you can get to the spot where you wreck and kill a buch of children that much quicker. Sounds fair to me. After all, you should be allowed to do whatever you want seeing how you are obviously "special".
